PLEASE READ THIS “TERMS OF USE” AGREEMENT CAREFULLY BEFORE USING ANY INFORMATION PROVIDED BY SPORTSACTIONCHARTS.COM.
SportsActionCharts,LLC (“we”, “us”, “our”, “SportsActionCharts.com”) provides sports wagering information via its website (“Site”, www.SportsActionCharts.com), via email, and in other formats. Any information or products or services you use from SportsActionCharts.com are subject to your compliance with the terms and conditions set forth in this Agreement. By using our information, you agree to be bound by these terms and conditions. This Agreement is made between SportsActionCharts.com and you, the user and/or member of the Site (“you”). We reserve the right at any time to: Change the terms and conditions of this Agreement; Change the Site, including eliminating or discontinuing any content or features on the Site; or Change any fees for use of the Site.
Code of Conduct. While using the Site you agree NOT to:
- Copy, frame or mirror any SportsActionCharts.com information without our prior written authorization;
- Permit anyone else whose account or subscription was terminated, or who is not a SportsActionCharts.com paid or trial subscriber, to use the Site through your subscription, username or password;
- Engage in spamming, flooding or hacking;
- Transmit any materials that contain any computer virus, worm, or other harmful or disruptive element;
- Modify, adapt, sublicense, translate, sell, reverse engineer or disassemble any portion of the Site;
- Remove any copyright, trademark, or other proprietary rights notices contained in the Site.
Registration for Subscriptions. You must be 18 years of age or older to subscribe to any of our services. When you register to subscribe, you agree to (a) provide accurate information about yourself as prompted by the appropriate registration form, and (b) to maintain and update your information to keep it accurate, current, and complete.
You agree not to transfer or resell your use of or access to any information from SportsActionCharts.com to any third party. If you are a SportsActionCharts.com subscriber, and you have reason to believe that your online account is no longer secure, you must promptly change your password by updating your account information and/or immediately notify us by emailing us at: support@SportsActionCharts.com Some of our subscription services involve email or fax transmissions as delivery methods. We assume no responsibility or liability for undelivered or late emails, whatever the reason may be. If you have problems getting your products delivered, contact our Customer Service department at support@SportsActionCharts.com. We will make every effort to assist you in potential solutions that may fix delivery issues.
Payment and Renewal. Current subscriptions are available on SportsActionCharts.com’s Services and Products pages. Payment for your subscription is due in advance of the subscription period you select. SportsActionCharts.com does not automatically renew subscriptions unless you subscribe to an auto-bill program for your convenience. The appropriate annual, quarterly, monthly, or similar periodic fee for your subscription will be billed at the beginning of your subscription period to the credit card you designate unless you notify SportsActionCharts.com in writing, according to our Cancellation Policy below, that you do must agree to the Terms of this Agreement upon receipt of this Agreement (either upon registration on the site, or upon purchase of any SportsActionCharts.com product or service.)
Cancellation Policy. You may cancel your subscription to SportsActionCharts.com at any time by notifying our support team IN WRITING via email. Cancellations may be emailed to support@SportsActionCharts.com . Cancellation will take effect no later than 3 business days after we receive your notification.
Refund Policy.
Because we offer a trial, refunds will only be prorated according to schedule below. We reserve the right to block future access of those deemed as tire kickers( people who use service and request a refund on multiple occasions.)
If subscribed to an annual service then a pro-rata refund will be offered based on the number of months used with the full list price for each month, or portion thereof, used deducted from total amount paid for the canceled service. Any pro-rata refunds will be made by Company check which will be mailed out within 4 weeks from our receipt of written cancellation. Monthly list prices which apply to this Policy are as follows:
Monthly Subscription / Service List Price
Each Sport $100 per month
Each month that a sport is active in that package that sports full price is deducted from the package refund amount. If one sport then $100 for that month, if two sports then $200 for that month. If 3 sports then $300 for that month. If the full amount of the package is realized, then the refund amount is zero.
Example
Purchase NFL and College Football Package for $500 in Sept 2010
Because there are two sports, the refund amount would be zero after three months.
Two sports realized at $200 per month times 3 months.
Seasonal Specials
For special promotions, like a “rest of the season” special, there may be a one time charge for the remainder of the season. The above charge of $100 per month applies. We reserve the right to block future access with those accounts, credit cards, Internet Protocol Addresses(IP)s that are deemed tire kickers.

Any commercial use of our site, images, services, products are strictly prohibited and punishable to the fullest extent of copyright and patent law. Commercial is permitted with written notice and agreement from SportsActionCharts.com.
Types of Commercial Use:
Affiliate Commercial-Non Sports Industry
With written permission; certain commercial non sports industry users can become affiliates and promote SportsActionCharts.com. This would allow them to use SportsActionCharts.com products and services with limited use according to agreed upon conditions.
Affiliate Commercial -Sports Industry
With written permission and special pricing; certain commercial users within the Sports Industry(relating to sports, sports betting, etc.) can become affiliates and promote SportsActionCharts.com. This would allow them to use SportsActionCharts.com products and services with limited use according to agreed upon conditions.
Commercial Non-Affiliate
With written permission and special pricing; certain commercial users can use SportsActionCharts.com products. This would allow them to use SportsActionCharts.com products and services with limited use according to agreed upon conditions.
Termination. This Agreement shall remain effective until terminated in accordance with its terms. SportsActionCharts.com may terminate this Agreement, and/or your access to and use of the Site or any portion thereof, immediately, in the event we determine, at our sole discretion, that you have breached this Agreement. In addition, we reserve the right, upon 10 business days’ notice and the reimbursement of any monies due according to the Cancellation Policy above, to terminate this Agreement without cause.

UNDER NO CIRCUMSTANCE ARE SPORTSACTIONCHARTS.COM, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS LIABLE FOR ANY INCIDENTIAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES OF ANY NATURE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH PROVIDING OR FAILING TO PROVIDE SERVICE, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR LOSS OF BUSINESS. THIS SECTION SHALL ALSO SURVIVE THE TERMINATION OF THIS AGREEMENT. Your sole remedy for dissatisfaction with the Site and/or content contained within the Site is to stop using the Site or other information from SportsActionCharts.com. The sole and exclusive maximum liability to the company for all damages, losses, and causes of action (whether in contract, tort (including, without limitation, negligence), or otherwise) shall be the total amount paid by you, if any, to access the Site or its contents.
Indemnification. You agree to indemnify, defend and hold us, our officers, directors, employees, agents and representatives harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, including any violation of the Code of Conduct above; or (b) your activities in connection with the Site or any services related to the Site. This section survives termination of this Agreement.
THIS AGREEMENT IS GOVERNED BY AND MUST BE CONSTRUED UNDER THE LAWS OF THE STATE OF DELAWARE, WITHOUT REGARD TO CHOICE OF LAW PRINCIPLES. YOU AGREE TO SUBMIT YOURSELF TO THE PERSONAL JURISDICTION OF THE COURTS IN THE STATE OF DELAWARE.
General Terms. If any part of this Agreement is held invalid or unenforceable, that part is interpreted consistent with applicable laws as nearly as possible to reflect the original intentions of the parties and the rest of this Agreement remains in full force and effect. SportsActionCharts.com and its officers and employees are not providing advice of any kind. We are simply a research organization, seeking to provide unbiased information for educational purposes only. Readers are advised that the commentary and reports on its website and in its newsletters are issued solely for information purposes and should not to be construed as an offer to sell or the solicitation of an offer to act in any way. The opinions and analyses included herein are based from sources believed to be reliable and written in good faith, but no representation or warranty, expressed or implied, is made as to their accuracy or completeness.
